Abstract:	Die Art. 19 und 20 OR stehen heute im Zentrum zahlreicher praktischer rechtsdogmatischer Probleme, die im Zusammenhang mit dem Paradox der "Vertragsfreiheit innerhalb der Schranken des Rechts" stehen. Der vorliegende Text untersucht diese praktischen Probleme aus dem Blickwinkel der zwingenden Inhaltsnormen, die nach Ansicht des Autors allein in Art. 19 Abs. 2 OR erfasst werden. Der Autor stützt sich dabei auf rechtsdogmatische, rechtshistorische und rechtstheoretische Überlegungen.
